Terms and Conditions CONDITIONS OF PAYMENT We quote net prices. Any applicable value-added tax is charged separately. Except were agreed otherwise, all prices are ex works, and do not include freight, delivery or unloading. Payments shall be made without deductions in the prevailing currency. Payment shall be in cash, by cheque, bank transfer, cash on delivery if possible, or against documents. Cheques shall be accepted for the purpose of payment and not in lieu of payment.The costs of discounting and collection shall be borne by the Purchaser. All prices are net prices in Euro, aditionally value added tax (VAT, MwSt). Intra-Community supplies to customers in Member States of the EU with a valid VAT number do not include VAT (MwSt), neither Export outside EU. No delivery on open account outside Austria. In case of payment delays beyond the due date, or in case of granted payment extensions, the Purchaser shall pay customary interests. Overdue fines are Euro 5,00 each demand note. All merchandise remain in our ownership until all presently existing payment claims have been fulfilled and any dept balance of an open account has been paid. Court of juristiction and place of delivery and payment is Salzburg. Conditions on delivery in general. All risks shall pass to the Purchaser at the time when we hand the merchandise to the transportation company, when we effect the shipment or when the merchandise is picked up by or on behalf of the Purchaser at our works. We herewith assign to the Purchaser any claim which we may have against the transportation company. All other claims against us in connection with the transportation of the merchandise to the Purchaser or his designee are excluded. In case a non-compliance of delivery time is due to Force Majeure, the delivery time extends itself adequately. The Buyer shall examine the goods on arrival and inform the Seller about obvious defects without further delay. As far as there is a defect of goods the Seller can justify, the Seller is entitled to either rework by removing the defect or replace the goods. Conditions on delivery within Austria Delivery of goods worth more than Euro 350,00 net will be sent without freightcharges to the purchaser within Austria using DHL parcel service. Freight charges for shipments worth less than Euro 350,00 net have to be covered by the customer even within Austria. Shipments with a merchandise value more than Euro 700,00 net we will send free of charges to Germany. Miscellaneous Terms We sell only to commercial purchasers.
